Just knock the bloody thing down is the message in the Judgement published today by the Supreme Court of Andalucia. No appeal can be made. The Judges rejected all compensation claims from the promoters of the build, Azata del Sol, and ruled that the land it was built on is natural park property which belongs to Andalucia as part of the public domain, and must be transferred at once to ownership of the State. Algarrobico land compensation fixed by court (2,3 million euros) – demolition one step closer

The Supreme Court of Andalucía has ruled on the amount of compensation to be given to the builders of the controversial Algarrobico hotel in Carboneras in exchange for the land it’s on. This will, in theory, allow demolition of the hotel to start soon. The local courts said it was illegal. The regional courts said it was illegal. The National court said it was illegal. And now the Supreme Court of Spain has confirmed that it is illegal. But the townhall of Carboneras has insisted that the huge hotel built on the beach in Carboneras is legal and must be opened soonest. The Supreme Court has ratified the ruling of the Andalucian Supreme Court (TSJA) ruling that the Junta de Andalucía’s attempt to change the natural park of Cabo de Gata to permit the opening of the El Algarrobico hotel is unlawful. Audiencia Nacional reaffirms that Algarrobico is on illegal land

The Audiencia Nacional (National Audience, or Supreme court) has found against Azata, the promotors of the Algarrobico hotel, in a ruling that appears to: – Reaffirm that the hotel was illegally built on protected land; -That the promotors are not entitled to any compensation for the modifications to the Partial Plan of the area.
